As of October 17, 2005 we entered into a new era of bankruptcy
laws, both here in Los Angeles, California and across the United States. Anyone who has been following the new laws knows that this
is not going to be pleasant or easy. As attorneys, we are entering a
huge unknown as far as how the multitude of new provisions are going to
be interpreted by courts which, of course, impacts how we can advise
our clients. The new law even goes so far as to instruct attorneys NOT
to advise our clients about certain matters and provides penalties
for doing so. While this is arguably unconstitutional, for the time being it sets up all kinds of roadblocks in the attorney-client
relationship and imposes liability on attorneys for the accuracy of
information that you, the client, provide, necessitating that we
undertake extensive and expensive analysis and verification of every
piece of information on your bankruptcy papers.
I write all this to let you know that
while Congress has seemingly done everything in its power to destroy the rights
to which we have become accustomed (and which have had a very positive
benefit on society as a whole), to prevent people in need from being
able to affordably seek bankruptcy relief, and to prevent bankruptcy
attorneys from being able to effectively represent their clients, I am
not deterred. My pledge to you is that I will continue to represent you
vigorously and protect your rights, whether you are a debtor or a
creditor. I will stay as current as I possibly can on the new
developments and interpretations of the new laws and will advise you to
the best of my ability, even where Congress says I may not. I will work
as hard as I can to make your bankruptcy experience as smooth as
possible under the circumstances. I have been practicing exclusively bankruptcy law in Los Angeles since 1991 and am affiliated with several networks of attorneys and we are all
working together towards the common goal of making the system work for
you.
